STANDARD TERMS AND CONDITIONS
THIS DOCUMENT IS A WAIVER OF LIABILITY. BY SIGNING THIS DOCUMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO ALL TERMS OF THIS LIABILITY WAIVER AND RELEASE. YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES.
LIABILITY WAIVER AND RELEASE
BRICKHOUSE BOXING & FITNESS CORPORATION
THIS LIABILITY WAIVER AND RELEASE (this “Waiver”) is executed as of ___________________, by the undersigned member (“Member”), in favor of Brickhouse Boxing & Fitness Corporation (the “Gym”), its affiliates, owners, shareholders, officers, employees, contractors, trainers, representatives, successors, and assigns (collectively, the “Released Parties”).
- Activities Covered. Member acknowledges and agrees that this Waiver applies to all activities, classes, programs, services, equipment use, boxing sparring, and other forms of physical exercise or recreational activities offered by or conducted at the facilities of the Released Parties (the “Activities”).
- Assumption of Risk. Member understands and agrees that participation in the Activities, including, without limitation, boxing sparring, involves inherent risks of injury, illness, disability, or death, whether caused by Member’s own actions or those of others. These risks include, without limitation, physical exertion, contact with other participants, falls, equipment failure, and the possible presence of infectious diseases. Member voluntarily assumes all such risks, known and unknown, regardless of severity.
- Termination for Misconduct. The Member’s membership with the Gym may be terminated immediately if the Gym decides, in its sole opinion, that the Member has acted in a way that is unsafe, disruptive, abusive, or could harm other members, staff, or the Gym’s reputation. The member understands that the Gym not terminating the Member’s membership for specific activity is not a waiver of this right.
- Release and Waiver. To the fullest extent permitted by New York State law, Member hereby voluntarily releases, waives, and discharges the Released Parties from any and all claims, demands, losses, damages, expenses, liabilities, or causes of action, whether at law or in equity, arising out of or relating to personal injury, property damage, illness, disability, or death that may result from participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.
- Indemnification. Member agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, losses, causes of action, damages, costs, or expenses (including reasonable attorneys’ fees) arising from, or related to, Member’s participation in the Activities or Member’s breach of this Waiver.
- Medical Treatment. Member authorizes the Released Parties to seek emergency medical treatment on Member’s behalf if deemed necessary. Member releases and waives all claims against the Released Parties arising out of any such medical treatment or transportation.
- Fitness to Participate. Member represents and warrants that Member is physically fit and has no medical condition that would prevent safe participation in the Activities. Member agrees to notify the Released Parties in writing of any changes to Member’s health or medical condition that may affect participation in the Activities.
- Minors. If signing on behalf of a minor participant, the undersigned parent or legal guardian acknowledges and agrees that all provisions of this Waiver apply to the minor, and that parent or legal guardian has the authority to bind the minor to this Waiver.
- Governing Law. This Waiver is governed by and construed in accordance with the laws of the State of New York. Any disputes arising out of or related to this Waiver shall be resolved in the courts of general jurisdiction located in Suffolk County, New York.
- Severability. If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Entire Agreement. This Waiver constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior or contemporaneous oral or written agreements.
IN WITNESS WHEREOF, the undersigned Member has executed this Liability Waiver and Release as of date first noted above.

Recurring Billing:
Subscriptions are billed on a recurring basis (weekly/monthly) until cancelled. It is the member’s responsibility to ensure payment information is up to date.

Cancellation Policy:
You may cancel your subscription at any time. Cancellations must be submitted [10 days] before your next billing cycle to avoid being charged for the following period. No partial refunds are provided for unused time.

No Refunds:
All payments are final. Brickhouse Boxing Club does not offer refunds for missed classes, lack of use, or mid-cycle cancellations.

Class Access and Changes:
Your subscription grants access to specific classes as outlined in your membership plan. Brickhouse reserves the right to change class times, instructors, or offerings at any time.

Hold/Freeze Option:
Memberships may be paused for medical or travel reasons at the gym’s discretion. Requests must be submitted in writing with supporting documentation.

Assumption of Risk:
By participating in any classes or using the facility, you acknowledge the inherent risks of physical activity and release Brickhouse Boxing Club, its owners, coaches, and staff from liability for any injury, accident, or loss.

Code of Conduct:
All members are expected to treat staff and fellow members with respect. Brickhouse reserves the right to revoke membership for behavior deemed unsafe, disruptive, or disrespectful, with no refund.

Returns:
We accept returns on unworn, unused items within 7 days of purchase. Items must be in original condition with tags attached.

Exchanges:
Exchanges are allowed for size or defect issues within 7 days. We cannot guarantee availability of all sizes, but we’ll do our best to accommodate.

How to Return:
Email Brickhouseboxingandfitness@gmail.com or visit us in person. If returning by mail, customer is responsible for shipping unless the item was defective or incorrect

No Refunds:
All sales on memberships, class packages, and drop-in sessions are final. We do not offer refunds for missed classes, non-use, or mid-cycle cancellations.

Monthly subscriptions can be cancelled at any time with [X days] advance notice before the next billing cycle. Cancellation requests must be submitted in writing or through your member account.
